In terms of  Clause 2.3 of the Gazette No: 40407 it states that ‘’The compliance targets for 2.11.1,2.1.1.2, 2.1.2.1, 2.1.2.2 and 2.13 of the Skills Development Scorecard are based on the overall demographic representation of Black people as defined in the Employment Equity Act. For scoring purposes, the targets should be further broken down into specific criteria according to the different race sub-groups within the definition of Black in accordance with the Employment Equity Act requirement on equitable representation and weighted accordingly.” According to the above ICT sector codes clause, it would seem that EAP targets do apply to disabled skills spend. This clause is problematic, firstly with respect to how you calculate your skills spend as well as the fact that by virtue of being disabled, this group already falls under the designated group.
