National Labour Migration Policy Approved
Why this matters for your workforce planning and why EEA12 and EEA13 preparation is more important than ever
The South African Cabinet has approved the National Labour Migration Policy 2025 White Paper and the Employment Services Amendment Bill 2021. This marks a significant shift in how the country manages the employment of foreign nationals and introduces a new layer of responsibility for designated employers.
The new policy framework aims to align labour migration with South Africa’s socio-economic priorities while tightening compliance through legal enforcement and proposed sectoral quotas. Employers who are not ready could find themselves under serious pressure.
What you need to know
- Regulating the hiring of foreign nationals
The policy proposes that the Minister of Employment and Labour may set limits on the number of foreign nationals hired in specific sectors or regions, depending on critical skills needs and unemployment levels.
- Balancing transformation and skills demand
The policy acknowledges the need for foreign skills but places strong emphasis on upskilling South Africans and protecting local job opportunities.
- Legal enforcement and compliance risk
Non-compliance may result in penalties and reputational damage. Now is the time to start reviewing your workforce profile, recruitment practices and internal policies.
Why your EEA12 and EEA13 should not wait
With policy and compliance requirements tightening, completing your EEA12 and EEA13 early is no longer just a good practice, it is a necessity. Every year we see companies leaving it until the last minute, only to realise they have gaps, outdated data or no proper equity plan in place.
By preparing early, you:
- Save yourself from the year-end panic
- Ensure your data is accurate and aligned with DoL expectations
- Give yourself enough time to build a meaningful and realistic EE Plan
- Identify and address internal transformation challenges proactively
- Avoid errors that can result in audits or penalties
